Thank you for supporting the Summa Health Dream House Raffle Promotion, conducted by Summa Health Foundation (“Summa””). Your purchase of one or more Summa Health Dream House Raffle ticket(s) signifies your agreement to the following Terms and Conditions and acceptance of the Official Rules. In the event of any dispute, the interpretations and determinations by Summa Health regarding the application of these Terms and Conditions and Official Rules are final and binding. The Summa Health Dream House Raffle Promotion is void where prohibited by law.
The purchase of one ticket equates to one entry. Ticket sales (entry dates) begin June 22, 2017, 9:00 am EST and close October 24, 2017, 12:00 am midnight EST or until 5,000 tickets are sold (whichever occurs first).
To be eligible to purchase a ticket, you must be at least 18 years old before the entry date and a living resident of the United States. The following persons, and their employees and family members living at the same address, are not eligible to purchase a ticket:
A ticket purchased by an ineligible person is void, and cannot be a winning ticket. No refunds will be made to ineligible purchasers.
A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was “declined,” or reported as “invalid” or “stolen” is void, and cannot be a winning ticket.
A ticket represents a chance to win the opportunity to accept an offer of the stated prize. All sales of tickets are final, and no refunds will be paid. Tickets, prizes, receipts, and any winner’s rights are not transferable.
The IRS has ruled that a payment for a raffle ticket is a tax-deductible charitable contribution only to the extent the amount of the payment exceeds the price of the ticket.
All purchases must be conducted online at www.summahealth.org/DreamHouse. One ticket equals one entry. There is no limit to the number of tickets purchased per eligible person.
On or close to October 25, 2017, the prize winner will be selected in a random drawing from all eligible entries. Odds of winning depend upon the number of tickets sold. A maximum of 5,000 tickets will be sold. All tickets have an equal chance to win. Ticket purchasers need not be present to win.
Grand Prize: The grand prize will be (a) the Summa Health Dream House or (b) a cash option of $100,000.00. The Summa Health Dream House has an estimated value of $318,000.00 When Summa Health sends the holder of the grand prize winning ticket the Winner Notification Agreement (“WNA”), the winner must indicate his/her choice of either the cash prize or the Summa Health Dream House, sign the WNA and return it to Summa Health within fifteen (15) days. If the winner accepts the Summa Health Dream House, title transfer will occur after payment of the applicable taxes has occurred and all requirements for occupancy are completed. If the winner chooses to accept the Summa Health Dream House, he/she will take ownership subject to all applicable federal, state, and local land use restrictions, and to any covenants, rules, or other restrictions administered by a homeowners’ or condominium association, or other community organization.
The Summa Health Dream House is a new construction home, built exclusively for this promotion. Construction will be complete by the time of the drawing. Additional construction modifications are not applicable. The Summa Health Dream House is located in Stark County, Ohio.
Limit of one prize per person per household. All prizes are non-transferrable. Neither Summa nor the prize sponsors will replace any lost, stolen or vandalized prizes.
The Grand House prize will be awarded to a winner. If the ticket has more than one name on it, the prize will be awarded to the eligible individual whose name appears first on the ticket. That individual is solely responsible for allocating the value of the prize among the purchasers.
Summa Health will notify each winner in writing by sending a Winner Notification Agreement (“WNA”) by certified U.S. mail, return receipt requested, to the mailing address provided by the purchaser. Each winner must accept the prize, “as is,” by signing the WNA and returning it to Summa Health within fifteen (15) days after the date the WNA was received. If a winner fails to accept the prize, the prize is forfeited and no substitute or alternative prize will be provided. A forfeited prize will be awarded to the next winner that was selected in the drawings.
Acceptance of a prize constitutes permission for Summa Health to use the winner’s name, picture, video image, and relevant quotes to promote the Summa Health Dream House Raffle, and agreement by the winner that the prize will not be used for fundraising for another charity.
The winner of each prize shall have no rights in or to the prize itself until he/she has timely executed the WNA and returned it to Summa and until delivery of the prize to the winner has been completed. Until that time, as between Summa and the winner, each prize remains the sole property of Summa.
The value of each prize is includible in the winner’s gross income, and may be subject to reporting by Summa to the Internal Revenue Service. Each winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize. The winner of the Summa Health Dream House agrees that the value of the property reported by Summa for income tax and other purposes will be based on the written appraisal obtained by Summa from a licensed appraiser.
With respect to any prize whose value is more than $5,000, the Internal Revenue Service requires Summa to withhold federal income tax at the rate of 28%, and the winner must pay the amount of tax to be withheld to Summa as a condition of transfer of ownership of the prize.

The Summa Health Dream House Raffle Promotion (“Raffle”) is conducted in English. In the event of any discrepancy related to a translated version, the terms and conditions of these English Official Rules shall prevail, govern and control. Purchasers of tickets (“Entrants”) assume all risk of loss, damage, destruction, delay or misdirection of Raffle materials submitted to Summa. In the event any portion of this Raffle is compromised by activities beyond the control of the Summa which, in the sole opinion of the Summa, corrupt or impair the administration, security or fairness of the Raffle, Summa reserves the right, at its sole discretion, to modify, suspend or terminate the Raffle. Winning a prize constitutes permission for Summa and its agencies to use prize winners’ names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Raffle only, without further compensation, unless prohibited by law. Summa may prohibit an Entrant from participating in the Raffle or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Raffle by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Summa, or prize contributors. If for any reason this Raffle is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Summa which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Raffle, then Summa reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Raffle and randomly draw from those entries received up to the cancellation/suspension date to award prizes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
Each winner accepts the prize “as is,” and without recourse to Summa with respect to any defect, injury, damage, or other problem that may arise or become apparent with respect to the prize. Summa disclaims any and all warranties with respect to each prize, including but not limited to any warranty of fitness for a particular purpose.
Because Summa has no right to control, nor exercises any control, over the personnel, equipment, or operations of any builder, seller, or manufacturer of any prize, or any part of any prize, Summa assumes no responsibility for any financial loss, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity that a winner may experience by reason of (1) performance or nonperformance by any supplier; (2) wrongful, careless, negligent, or unauthorized acts or omissions by any supplier or its employees, or by any other party not under the control of Summa; (3) any defect, breakdown, or other failure of any aircraft, train, automobile, ship, accommodation, or other equipment or instrumentality owned, operated, or otherwise used by a supplier; (4) acts of God and acts or omissions of third parties; (5) mechanical or construction failures: or any other event or condition beyond Summa’s control. Each winner hereby releases and holds Summa harmless with respect to any claim based on any such occurrence.
Summa shall in no event be liable for special or consequential damages arising from the use or ownership of any prizes.
